Hence I have had people who have a current external provided certificate that indicates they are trained but I have revoked the permission to operate because they did not demonstrate competence.
I have also over shot on the reccomended re fresher date when I have been able to provide PROOF that the person is competent to continue safely. Regards Garry. The law requires Employees to be competent to undertake activities and the Employer is required to ensure that this is the case, whatever the activity is.
But just because someone has a card or certificate saying they have attended a course in operating an XYZ machine, it's still the employers responsibility to allow them to use the machine; it's not a 'licence' to be taken as carte blanche authority; a mistake many employers make.
Taking this to the extreme perhaps, if you have a category H Driving Licence Tracked Vehicles it would be a foolhardy employer that allowed you to take a government surplus Tank on the highway without ensuring you were competent in that specific vehicle first! There is nothing to stop a large organisation having it's own training department, conducting it's own bespoke training courses and issuing it's own permits or authority to operate, which may or may not have a 'grace period'.
